§ 50-6. Petition—By owners.

  • Whenever 75 percent or more of the owners of the lands involved in the area to be benefited as well as the owners of 51 percent or more of the lands involved in the area to be benefited deem it desirable to make demand, in writing, as provided in section 50-8, that the board make available certain governmental services, facilities, or programs as may provide a special benefit to their property, and after a public hearing to determine practicality and feasibility, the board may adopt and enact, if it so desires, an assessment ordinance together with all appropriate and legally required resolutions to make any or all of the improvements in the written petition. Nothing in this chapter shall be construed to limit or restrict the board from adopting an assessment ordinance which imposes a special assessment for specified governmental services, facilities, or programs not contained in the written petition.
