§ 70-2. Regulation in unincorporated areas.

  • (a)

    Authorization of board. The board of county commissioners is hereby authorized to regulate utilities in the unincorporated areas of the county, as provided within this chapter.

    (b)

    Public health, safety and welfare. The regulation of utilities is declared to be in the public interest, and this chapter is an exercise of the police power of the county for the protection of the public health, safety, and welfare. The provisions of this chapter shall be liberally construed for the accomplishment of this purpose.

    (c)

    Exemptions. The following are not subject to regulation by this chapter as a utility:

    (1)

    The sale, distribution or furnishing of bottled water;

    (2)

    Systems owned, operated, managed or controlled by governmental agencies;

    (3)

    Manufacturing, mining, or agricultural operations providing service solely in connection with their operations;

    (4)

    Establishments such as hotels, motels, mobile home parks or recreational vehicle parks providing services solely in connection with service to their guests;

    (5)

    Systems designed to serve or serving 100 persons or less; and

    (6)

    Nonprofit corporations, associations, or cooperatives providing service solely to members who own and control such nonprofit corporations, associations or cooperatives.
