§ 66-45. Civil penalties for violation of article.

  • (a)

    Any person cited for parking in violation of this article may pay a fine in lieu of a court appearance for the offense in accordance with the following fine schedule:

    (1)

    Any person cited for a class I parking violation may pay a fine of $10.00 within ten calendar days from the date the citation was issued.

    (2)

    Any person cited for a class II parking violation may pay a fine of $17.00 within ten calendar days from the date of the citation.

    (3)

    Any person cited for a class III parking violation may pay a fine of $250.00 within 20 calendar days from the date of the citation.

    (b)

    If a person cited for a parking violation fails to pay the prescribed fine within ten calendar days after issuance of the citation, inclusive of the date of the citation, the amount of the civil penalty assessed for a class I or class II violation shall be doubled, and the person so cited may pay the doubled civil penalty within 20 calendar days of the date of the citation. Any person cited for a parking violation who fails to pay the required fine within 20 calendar days, but who wishes to pay a civil penalty in lieu of a court appearance, may, after notification by the clerk pursuant to section 66-46, pay the doubled fine, plus $5.00 for the cost of mailing such notice; provided, however, that if a person, after receiving notification from the clerk's office, signs a sworn affidavit indicating that such person did not receive nor have prior knowledge of the citation, then such person may pay the original fine and shall not be responsible for the double fine or mailing cost.
