§ 66-44. Violation classifications.

  • (a)

    Class I violation. It shall be unlawful for any person to stop, stand, or park a motor vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers or except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or traffic control device, in any of the following places:

    (1)

    On a sidewalk.

    (2)

    Within an intersection.

    (3)

    On a crosswalk.

    (4)

    Within 20 feet of a crosswalk at an intersection.

    (5)

    Upon any bridge.

    (6)

    In front of a public or private driveway without the owner's consent.

    (7)

    Alongside or opposite any street excavation or obstruction when such stopping, standing, or parking would obstruct traffic.

    (8)

    Upon any pavement of any subdivision street where parking has been prohibited on such streets by the board of county commissioners, as evidenced by a no parking sign placed along such streets.

    (9)

    On any parking space for a period longer than that authorized by an official traffic control sign or in a metered parking space longer than allowed (overtime parking).

    (10)

    At any other place not specifically designated in this article where official signs prohibit stopping, standing or parking.

    (11)

    Within 30 feet upon the approach to any flashing beacon, stop sign, or traffic control signal located at the side of a street.

    (12)

    So that any part of the motor vehicle shall come within ten feet of the nearest rail of a railroad crossing.

    (13)

    On the street side of any motor vehicle stopped or parked at the edge of a curb or street, which is commonly known as double parking.

    (14)

    For any vehicle of one-ton capacity and larger to be parked within a county right-of-way. Momentary stopping to make deliveries shall not be deemed to be a violation of this subsection unless such action would create a traffic or safety hazard.

    Any person stopping, standing or parking a motor vehicle in violation of this subsection shall be cited for a class I parking offense.

    (b)

    Class II violation. It shall be unlawful for any person to stop, stand, or park a motor vehicle, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or a traffic control device, in any of the following places:

    (1)

    Within any fire lane identified by a sign as a fire safety lane, whether the same be on public property or on private property, where the public has a right to travel by motor vehicle.

    (2)

    Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance of any fire station within 75 feet of such entrance.

    (3)

    Within 15 feet of a fire hydrant.

    Any person found stopping, standing, or parking a motor vehicle in violation of this subsection shall be cited for a class II parking violation.

    (c)

    Class III violation. It shall be unlawful for any person to stop, stand, or park a motor vehicle, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or a traffic control device, in any space reserved for handicapped parking unless the person parking in such space is authorized to do so pursuant to state statute. Any person found stopping, standing, or parking a motor vehicle in violation of this subsection shall be cited for a class III parking violation.
