§ 2-186. Definitions.

  • [The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:]

    Board shall mean the Board of County Commissioners of Okeechobee County, Florida.

    Citation means a written notice issued to a person by an officer that the officer has probable cause to believe that the person has committed a civil infraction in violation of a duly enacted county code or ordinance, including the land development regulations (also known as the "LDRs", also known as the "Okeechobee County Code Part II") which comprise a part of the Okeechobee County Code, and that the county court may, if contested, hear the charge.

    Code shall mean the Code of Ordinances of Okeechobee County, Florida, and the Okeechobee County Land Development Regulations (also known as the "LDRs" also known as the "Okeechobee County Code Part II"), both as may, from time to time, be amended.

    Code enforcement board shall mean the code enforcement board created and established by Ordinance No. 82-4, as amended by Ordinances Nos. 85-4, 91-3, and 94-8.

    Code enforcement officer means any authorized agent of the county whose duty it is to assure code compliance by enforcing the codes and ordinances of the county, and who has the power to issue citations as provided in F.S. ch. 162.

    Code inspector shall mean any authorized agent or employee of the county whose duty it is to ensure code compliance.

    County shall mean Okeechobee County, Florida, a political subdivision of the State of Florida.

    Department shall mean the Okeechobee County Department of Planning and Development, as created and organized by Ordinance No. 94-8, now also known as the Okeechobee County Community Development Department.

    Initial pleading shall mean the first notice of violation or first notice of repeat violation issued to a person concerning a violation of the Code.

    Officer means and shall include any and all of the following: Any law enforcement officer defined in F.S. § 943.10, any animal control officer as defined in the Okeechobee County Code or as defined in F.S. ch. 828, and any code enforcement officer as defined in this chapter of the Okeechobee County Code or in F.S. ch. 162.

    Special magistrate shall mean the Okeechobee County Code Enforcement Special Magistrate created by section 2-187 of this article.

    Repeat violation means a violation of a provision of the Code by a person who has been previously found by the code enforcement board or any other quasi judicial, judicial, or special magistrate proceeding to have violated or who has admitted violating the same provision within five years prior to the violation, notwithstanding that the violations occur at different locations.
