§ 42-31. Definitions.

  • (1)

    Animal. Means any living dumb creature.

    (2)

    Facility. Means any building, structure, appurtenance, equipment, machine, or other improvement located on any county owned, controlled or managed real property located within Okeechobee County, Florida. This definition specifically includes, but is not limited to buildings (whether or not such buildings are for recreational use), restroom facilities, fences, railings, benches, tables, playground equipment, water fountains and irrigation equipment, lighting, drainage facilities such as ditches and swales, handball, racquetball, tennis and basketball courts, batting cages including associated items such as back stops and nets, ball fields or diamonds, including fields together with their associated goals, markers, and stands.

    (3)

    Park. Means any county owned, operated, or managed real property which is set aside or available for public use. This definition shall include but not be limited to the park proper, boat ramps, landings, docks, piers, parking lots and dedicated access roads and any appurtenant drainage systems.

    (4)

    Persons. Includes, but is not limited to, any individual, corporation, company, association, firm, partnership, society, or joint stock company.

    (5)

    Service animal. Means an animal that is trained to perform tasks for an individual with a disability. The tasks may include, but are not limited to: guiding a person who is visually impaired or blind, alerting a person who is deaf or hard of hearing, pulling a wheelchair, assisting with mobility or balance, alerting and protecting a person who is having a seizure, retrieving objects, or performing other special tasks. A service animal can be either a dog or a miniature horse. A service animal is not a pet.

    (6)

    Trespass. Means in addition to those acts described in F.S. §§ 810.08, 810.09, 810.115 and 810.12, trespass for purposes of this section shall also include the entry upon or remaining within a park or facility outside of the posted operating hours of that park or facility.
