§ 26-43. Unconscionable prices—Generally.

  • Upon a declaration of a state of emergency by the governor or the county board of county commissioners or such other designee as may be provided for by this Code, it is unlawful and a violation of this division for a person or his agent or employee to rent or sell or offer to rent or sell at any unconscionable price within the area for which the state of emergency is declared, any essential commodity including, but not limited to, supplies, services, provisions, or equipment that are necessary for consumption or use as a direct result of the emergency. This prohibition remains in effect until the declaration expires or is terminated.
