§ 22-111. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Flea market merchant vendor means any person as defined in F.S. § 212.02(13), who solicits, engages in, transacts or offers for sale any new or used merchandise and for the purpose of transacting such business, rents, hires, leases, occupies or uses any building, structure, lot, tract, display case or any portion thereof within a flea market or swap shop. This definition shall not include a person engaging in an occasional or isolated participation in a flea market or swap shop, and the person does not hold himself out as engaged in business and if the person does not conduct more than two sales events per year.

    Flea market operator, manager, lessor or owner means any person who provides spaces to flea market merchant vendors.

    Stall, unit or booth means any divided or delineated area or table designed or intended to be rented or leased to any flea market merchant vendors and nonmerchants for which a fee or rental is charged.
